‼️As a patent strategist who works exclusively with startup companies, I don’t care what my startup clients invented. Full stop.

🤦‍♀️And if you’re a startup founder, this probably runs directly against the question your patent lawyer usually asks you from the get go:

🫵“What did you invent?”

🤔It sounds logical if only because patents are supposed to protect "inventions."

🎢It’s also where most startup patent strategies inadvertently go off track.

🧑‍🦯‍➡️Because the "what did you invent?" inquiry assumes something most startups don’t actually have yet: clarity on what will drive value in the business.

⛔And here’s the part that founders likely don't realize--your patent attorney may not know the difference between what a startup needs… and what an established company needs.

🙂‍↔️They’re not doing anything wrong. They’re doing what they’ve been trained to do. But that training is largely built around companies that already know

☑️what customers will buy
☑️where revenue comes from
🎯what needs to be protected to cover the customers and revenue

🔀Startups are in a completely different position.

🔭They're still figuring out how to position their tech or products so that customers will buy from them at scale. And, if they haven't yet pivoted, they will--likely multiple times.

😭Which means if startup founder default to the same patenting approach used for established companies, they can end up protecting what they’ve already built in the past…instead of what will drive scalable revenue streams in the future.

🧐I see this play out all the time.

🔬The issue isn’t patent quality. It’s strategic focus.

🥂And this gap typically doesn’t show up until it may be too late: after the startup has customer validation and growing revenue. That is, when the business evolves into a success.

😞Unfortunately, this success may be short-lived if the startup's patent strategy was not solidly constructed.

👂Hear this: If you’re a startup founder building in an environment where your product, your customer, and even your business model may change, your patent strategy has to reflect that reality.

🛑Otherwise, you may end up very well protected… but for the wrong product. Importantly, a broad patent that covers the wrong product is worthless to the startup because it protects something that no one likely wants to buy.
